Alacaklının, borçlu tarafından gereği gibi yapılan bir ifa teklifini haklı bir sebebi olmaksızın kabul etmekten kaçınması veya kendine düşen hazırlık fiillerini yerine getirmemesi halinde alacaklının temerrüdü meydana gelir. Alacaklının temerrüde düşmesiyle beraber borçluya birtakım imkânlar tanınmıştır. Bu imkânların bazıları kanunda düzenlenmemişken bazıları ise açıkça düzenlenmiştir. Bu tez çalışmasında, alacaklının temerrüdünün hukukî niteliği, şartları ve sona ermesi üzerinde durulmuştur. Ardından alacaklının temerrüde düşmesiyle beraber doğan hüküm ve sonuçlar incelenmiştir. |

Where the creditor, refuses to accept a duly tendered performance by the debtor or fails to carry out the preparatory acts incumbent upon him, without a legitimate reason, the creditor is deemed to be in default. Upon the creditor's default, the debtor is entitled to certain opportunities, some of which are not statutorily regulated, whereas the others are explicitly provided for in the law. This dissertation focuses on the legal character, prerequisites, and termination of the default of the creditor. Furthermore, the legal effects arising from the creditor's default are also analyzed. |
